Disputes over Children
Your need...
Children can be affected in all sorts of ways when their parents separate, and this can be distressing both for them and for you. You may need to agree where the children will live, and when and where they will see the other parent. Children need certainty and routine to their arrangements, and you will want to do your utmost to achieve this and put their interests first.
You will also want to make sure that the handling of all issues and arrangements related to your children is done sensibly and with sensitivity.
How we can help...
We take time to understand your situation and your needs. We can advise you on your legal position in relation to your children, and guide and support you to find the right solutions, ensuring that you and your children are protected.
If there is disagreement about where the children will live (or ‘residence’) or arrangements for contact (sometimes called ‘access’), or other issues such as where they should go to school, or what their surname should be, we provide expert, practical advice.
No-one wants to think about what would happen if a parent dies, but you might want to consider appointing a Guardian for the children in your will. Our family law team provides a seamless service with our specialist wills team who can advise and help you prepare your will, so you can get on with your life knowing the basics are in place.
We advise parents in situations where one or the other parent wants to re-locate abroad. We can also provide assistance in emergencies where there is an allegation of possible abduction.
If you are a step-parent, you may have discussed with your partner the idea of adopting your step-children. It can seem a complex process and difficult to know where to start. We will advise you in jargon-free language and guide you through the process.
As Resolution members we are committed to a non-confrontational, child-focussed approach, to avoid involving children in an emotional ‘tug-of-war’. Whether you want us to negotiate on your behalf, represent you in court, mediate or if you choose collaborative law, we help you make informed choices and are with you every step of the way.
We can also help you with other areas of support and advice for any emotional issues experienced by you or the children.
Grandparents can sometimes get forgotten, or excluded, when parents separate. We can help grandparents to see their grandchildren.
Trust us...
Our primary aim is to reach the right solution to meet the needs of you and your children. Communication is key to this. Our family law team has the expertise and vast experience of helping parents find solutions and we are dedicated to ensuring your children’s best interests are met.
