FAQ
How much does a divorce cost?
Until Mid-April, we are offering a reduced price of £360 inc VAT. This is usually priced at £600 inc VAT. Please note that there is a Court Fee to apply for the Divorce of £612.
What does the process involve?
The process is relatively straightforward. An application is made to the Court on your behalf to end your marriage. The other spouse then has a limited time to respond. Once a response is made, we can, with your instructions, apply for the Conditional Order (previously Decree Nisi). Once the Conditional Order is made you must wait 6 weeks and 1 day before you can apply for the Final Order (previously referred to as Decree Absolute).
Please note that if your spouse does not respond in time there is further work and possible applications which need to be made to the Court.
How long does it take?
Most straightforward divorces take at least 9 months to complete. There are waiting times built into the process which must be followed. You should be aware that under the new Divorce Process there is a “cooling off period" of 20 weeks before you can apply for the Conditional Order.
If your spouse is not cooperative, this process may take longer and may incur further costs.
Does the divorce need to be finalised before the end of the offer?
No it does not, as long as you instruct Emsleys before the closing date, and the divorce is issued on the Court Portal then our offer applies.
What is the Court Fee?
The Court Fee is paid direct to the court and is separate to legal fees. This fee may not be applicable or reduced if you are on low income.
Which additional costs may be incurred?
Additional costs may be around obtaining a copy of your Marriage Certificate if you do not hold a certified copy, arranging personal service of the papers if your spouse does not respond, or making an application to withdraw previous divorce proceedings.
You should also be aware that matters relating to finances flowing from divorce are separate and charged at our hourly rate.
