What is ATE insurance?

After the Event (ATE) insurance protects a claimant from paying their opponent’s legal fees and expenses when making a personal injury claim.

When you choose Emsleys Solicitors to make a personal injury claim on your behalf, you will usually agree to a ‘no win, no fee’ agreement to fund your case.

‘No win, no fee’ is also known as a ‘conditional fee agreement’. A conditional fee agreement will protect you from paying our legal costs if your claim is unsuccessful. If we win your case, our costs will be recovered from your compensation – we take no more than 25% of any damages.  

However, irrespective of whether your claim is successful or not, when making a claim expenses such as medical appointments cannot be met by a conditional fee agreement. If you don’t have legal expenses insurance, we can arrange ATE insurance so that regardless of the outcome of your claim, the ATE insurer will meet the costs of any expenses outside our conditional fee agreement. If your claim is unsuccessful, the ATE insurer will waive their insurance premium.

ATE insurance is only taken out with a client’s consent, but we recommend it to avoid the risk of any financial implications when you make a claim.
