10 questions to ask your solicitor when offered a Settlement Agreement?

  1. What happens if I do not sign?
  2. What amount of money am I being offered and what am I entitled to anyway? Put another way, what is my financial incentive to sign?
  3. I have been offered  but I would like . Can I renegotiate and settle for ?
  4. Can my last day of work be changed?
  5. What happens to my holiday entitlement?
  6. If I am being told the money is tax free why is there a tax indemnity clause in the Agreement saying I am responsible for any tax?
  7. Are there any post-termination restrictions (e.g. working for a competitor; soliciting customers; poaching staff) that will hamper me in the job market?
  8. Does the Agreement include an employment reference and is a basic reference enough?
  9. What can I say when someone asks me about what is happening at work?
  10. What else do I need to know?
