Artificial Insemination & Legal Parentage – knowing your rights

As the law continues to develop for same sex families, we are experiencing more and more enquiries regarding the legal rights of a parent who has been involved in the birth of a child born by artificial insemination or assisted conception.

We have therefore created some helpful flowcharts to determine your status as a parent.

The flowcharts assume that your child has been born after 6th April 2009, when the Human Fertilisation and Embryology Act 2008 came into force.

The law on this subject is very complex, and the flowcharts summarise the position to a large extent, however there  are many other factors to consider and we therefore recommend seeking legal advice if you are considering  Artificial Insemination.
